Etika Bisnis (Tulisan 4)


Etika bisnis disekitar kita (Etika Bisnis dan Pendidikan)
Dalam sistem perekonomian pasar bebas, perusahaan diarahkan untuk mencapai tujuan mendapatkan keuntungan semaksimal mungkin, sejalan dengan prinsip efisiensi. Namun, dalam mencapai tujuan tersebut pelaku bisnis kerap menghalalkan berbagai cara tanpa peduli apakah tindakannya melanggar etika dalam berbisnis atau tidak.

Hal ini terjadi akibat manajemen dan karyawan yang cenderung mencari keuntungan semata sehingga terjadi penyimpangan norma-norma etis, meski perusahaan-perusahaan tersebut memiliki code of conduct dalam berbisnis yang harus dipatuhi seluruh organ di dalam organisasi. Penerapan kaidah good corporate governace di perusahaan swasta, BUMN, dan instansi pemerintah juga masih lemah. Banyak perusahaan melakukan pelangaaran, terutama dalam pelaporan kinerja keuangan perusahaan.

Prinsip keterbukaan informasi tentang kinerja keuangan bagi perusahaan terdaftar di BEJ, misalnya seringkali dilanggar dan jelas merugikan para pemangku kepentingan (stakeholders),terutama pemegang saham dan masyarakat luas
lainnya.Berbagai kasus insider trading dan banyaknya perusahaan publik yang di-suspend perdagangan sahamnya oleh otoritas bursa menunjukkan contoh praktik buruk dalam berbisnis. Belum lagi masalah kerusakan lingkungan yang terjadi akibat eksploitasi sumber daya alam dengan alasan mengejar keuntungan setinggi-tingginya tanpa memperhitungkan daya dukung ekosistem lingkungan.
Bisa dibayangkan, dampak nyata akibat ketidakpedulian pelaku bisnis terhadap etika berbisnis adalah budaya korupsi yang semakin serius dan merusak tatanan sosial budaya masyarakat. Jika ini berlanjut, bagaimana mungkin investor asing tertarik menanamkan modalnya di negeri kita? Situasi ini menimbulkan pertanyaan tentang mengapa kesemua ini terjadi? Apakah para pengusaha tersebut tidak mendapatkan pembelajaran etika bisnis di bangku kuliah? Apa yangsalah dengan pendidikan kita, karena seharusnya lembaga pendidikan berfungsi sebagai morale force dalam menegakkan nilai-nilai kebenaran dalam berbisnis?
Bagaimana sebenarnya etika bisnis diajarkan di sekolah—kalaupun ada—dan di perguruan tinggi? Etika bisnis merupakan mata kuliah yang diajarkan di lingkungan pendidikan tinggi yang menawarkan program pendidikan bisnis dan manajemen. Beberapa kendala sering dihadapi dalam menumbuhkembangkan etika bisnis di dunia pendidikan. Pertama, kekeliruan persepsi masyarakat bahwa etika bisnis hanya perlu diajarkan kepada mahasiswa program manajemen dan bisnis karena pendidikan model ini mencetak lulusan sebagai mencetak pengusaha. Persepsi demikian tentu tidak tepat. Lulusan dari jurusan/program studi nonbisnis yang mungkin diarahkan untuk menjadi pegawai tentu harus memahami etika bisnis. Etika bisnis adalah acuan bagi perusahaan dalam melaksanakan kegiatan usaha, termasuk dalam berinteraksi dengan stakeholders, termasuk tentunya karyawan.
Kalaupun disertai penggunaan studi kasus, sayangnya tanpa disertai kejelasan pemecahan masalah dari kasus-kasus yang dibahas. Hal ini disebabkan substansi materi etika bisnis lebih sering menyangkut kaidah dan norma yang cenderung abstrak dengan standar acuan tergantung persepsi individu dan institusi dalam menilai etis atau tidaknya
suatu tindakan bisnis. Misalnya, etiskah mengiklankan sesuatu obat dengan menyembunyikan informasi tentang indikasi pemakaian? Atau membahas moral hazard pada kasus kebangkrutan perusahaan sekelas Enron di Amerika Serikat. Keempat, etika bisnis tidak terdapat dalam kurikulum pendidikan dasar dan menengah.

Nilainilai moral dan etika dalam berperilaku bisnis akan lebih efektif diajarkan pada saat usia emas (golden age) anak, yaitu usia 4–6 tahun. Karena itu, pengajarannya harus bersifat tematik. Pada mata pelajaran agama, misalnya, guru bisa mengajarkan etika bisnis dengan memberi contoh bagaimana Nabi Muhammad SAW berdagang dengan tidak mengambil keuntungan setinggi langit. Kelima, orangtua beranggapan bahwa sesuatu yang tidak mungkin mengajarkan
anak di rumah tentang etika bisnis karena mereka bukan pengusaha. Pandangan sempit ini dilandasi pemahaman bahwa etika bisnis adalah urusan pengusaha
.
Pemerintah sebagai regulator pasar turut berperan mengawasi praktik negatif para pelaku ekonomi. Sudah saatnya pemerintah mempertimbangkan etika bisnis termuat dalam kurikulum pendidikan dasar dan menengah. Peran aktif para pelaku ekonomi ini pada akhirnya akan menjadikan dunia bisnis di Tanah Air surga bagi investor asing.
